Terms of Service

1. Agreement

By accessing or using Aqamony at aqamony.com("Service"), you agree to these Terms of Service with Vahagn Davtyan, doing business as Aqamony ("Aqamony", "we", "us", or "our"). If you do not agree, do not use the Service.

2. The Service

Aqamony helps you prepare product and creative images — including background removal, refinement, export, and download. Features may change as we improve the product.

3. Accounts

Some features require an account. You are responsible for your login credentials and for activity under your account. Provide accurate information and keep it up to date.

4. Credits, plans, and billing

• Free usage may include welcome credits, export limits, or other limits that we can change.
• Pro and paid plans are billed through Paddle (Merchant of Record). Paddle's checkout terms also apply to purchases.
• Credits / quotas are for legitimate use of the Service and are not transferable unless we say otherwise.
• Taxes, invoices, and refunds for paid plans are handled according to Paddle's policies and applicable law.

5. Your content

You keep ownership of images you upload. You grant us a limited license to host, process, and display that content solely to provide the Service (including AI processing providers we use).

You represent that you have the rights to upload and process the content, and that it does not violate law or third-party rights.

6. Acceptable use

You agree not to:

• Upload illegal, harmful, or infringing content
• Attempt to abuse credits, bypass limits, or disrupt the Service
• Reverse engineer or scrape the Service in an abusive way
• Use the Service to violate others' privacy or IP rights

We may suspend or terminate access for violations or abuse.

7. AI-assisted processing

Some tools use automated / AI processing. Results may be imperfect. You are responsible for reviewing outputs before using them commercially. The Service is provided for convenience and does not guarantee a specific quality level for every image.

8. Intellectual property

Aqamony branding, software, and site content (excluding your uploads) are owned by us or our licensors. You may not copy or reuse them except as needed to use the Service.

9. Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant uninterrupted or error-free operation.

10. Limitation of liability

To the fullest extent permitted by law, Vahagn Davtyan (doing business as Aqamony) will not be liable for indirect, incidental, special, consequential, or lost-profit damages, or for loss of data arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amounts you paid us for the Service in the 3 months before the claim (or USD $50 if you have not paid).

11. Termination

You may stop using the Service at any time. We may suspend or end access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that should survive (including IP, disclaimers, and liability limits) will survive termination.

12. Changes

We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use after changes means you accept the updated Terms.
